The appropriate Government while devising these schemes and programmes shall give due consideration to the diversity of disability, gender, age, and socio-economic status.
Provided that the quantum of assistance to the persons with disabilities under such schemes and programmes shall be at least twenty-five per cent. higher than the similar schemes applicable to others.

The RPWD Act 2016 proposes free health care in the vicinity,
especially in rural areas subject to “such family income” as may be notified. The RPWD Act should be amended “keeping the rights-based” spirit of the legislation. The amendment needs to modify the clause as “every person shall have a right to access physical and mental health care without any income limitation.”

RPWD Act, 2016, received the assent of the President on December
27, 2016. The preamble of this act clearly states that it aims to uphold the dignity of every Person with Disability (PwD) in the society and prevent any form of discrimination.
The act contains 17 chapters with 102 sections.

It defines Person with Disabilities as any person with long-term physical, mental,
intellectual, or sensory impairments which on interacting with barriers hinder effective and equal growth in the society. Further, it also defines “Person with Benchmark Disability” as a person with not <40% of specified disability.

Uttar Pradesh cabinet minister was the first one to be booked
under this new legislation when disability activist Satendra Singh (doctor) filed case against him on publicly humiliating a disabled employee. The addition of thalassemia as a new disability under this new law allowed a Chhattisgarh girl with this disorder to get medical admission after Supreme Court's intervention.
